 www.manicpaniceurope.com (the “Site”) is a site operated by Manic Panic N.Y.C., Inc. (“Manic Panic”). We are a corporation of the State of New York.

We are committed to protecting and respecting your privacy. We are responsible for protecting your personal information as a “data controller” under applicable data protection legislation. If you have any queries about this Policy or how we use your personal information, please contact us by writing to us at eugdpr@.com.

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us.  Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. By visiting our website, you are accepting and consenting to the practices described in this policy.

This policy is prepared in compliance with the requirements of the General Data Protection Regulation (EU) 2016/679 (“GDPR”), as in force from time to time. Where a particular provision applies to EU-based users only, we have made this clear. Protecting your personal privacy is very important to us at Manic Panic . Below you will find a statement of our commitment to ensuring the privacy of your personally identifiable information (information you provide to Manic Panic that personally identifies you, listed in Information We Collect, or other identifying information). This privacy policy statement is applicable to the  Site.

Information We Collect

The information we collect about you might include your full name, address, e-mail address, telephone number, and identification number. Whether you choose to give us information is completely up to you, but keep in mind that if you withhold information, you may not be able to use some of our services. If the collection of personal information is mandatory, we will make that clear at the point of collection so that you can make an informed decision on whether to provide your information.

The types of information we collect include:

  • Information you provide to us. Information provided by creating an account or paid membership on the Site, contacting us through the Site, or via email, including your name, address, email address, phone number, and credit card information, as described in greater detail below.
  • Automatically collected information. When you access our Site, some information not associated with specific users, such as device type, location information, IP address, webpage traffic, and access time is automatically collected in order to ensure the Site’s functionality.
  • Third-party sources. We may collect information from third parties to whom you have provided your information and consented to the sale, rental or transfer thereof (for example, through social media). 

How We Collect Information

We obtain personal information when you provide this to us via:

  • Becoming a Registered User of the Site.

In order to become a registered user of the Site, you need to share some personal information, such as your name and e-mail address. You do not have to be a registered user to visit the Site. But, you will have to register if you want to place orders or make full use of our services. Once you register, you will have an account with us and a password to access that account. You may never use another person’s account without permission and you may not use anyone else’s password. You should keep your registration current and complete. You are responsible for maintaining the confidentiality of your account and password. Please also let us know if there is any unauthorized use of your account or password. We recommend that you always log out from your account at the end of a session with us to prevent other people from accessing your account without your permission.

  • Making a Purchase on the Site.

When you buy something on Manicpanic.com, you have to supply your name, email, phone number, and shipping address. Your payment information will be processed through Shopify

  • Sweepstakes, Contests and Surveys at the Site.

If at the Site you enter a sweepstakes or contest, or answer a survey, you will become a registered user (if you aren’t one already). We may also ask you for some demographic information, such as your age. If you choose not to answer, you probably will not be able to participate in the sweepstakes, contest or survey.

  • Our Interactive Services.

We like to hear your opinions and feedback and answer your questions. We may offer such interactive services in the future and this Privacy Policy will govern your use of those services. If you want to use any of these interactive services, you will become a registered user (if you aren’t already one) and any personal information you submit will become part of your profile, as maintained by us. Please review our terms of use for the Sites because they explain the way you can participate in our interactive services in more detail.

  • Product Availability Notifications.

If a product that you want to purchase at the Site is not in stock, you can choose to provide us your e-mail address so that we can notify you when the product becomes available again. You do not need to be a registered user to receive a product availability notification.

  • Public Information.

Please note that if you choose to share information about yourself in an open format, such as through a Third Party Site like Facebook or Twitter or in the user-generated content elements of our own Sites, we consider that information to be public information – and not personal information.

 We record emails for quality assurance purposes.

  • If you have purchased services from us, we will collect information about your purchase history.
  • We may also collect technical information relating to your use of our website, including your browser type or the Internet Protocol (IP) address used to connect your computer to the internet.

We also gather general information about the use of the Site, such as which pages users visit most often and which services, events or facilities are of most interest. We may also track which pages users visit when they click on links in emails. We may use this information to personalize the way the Site is presented when users visit, to make improvements to the Site, and to ensure we provide the best service for users. Wherever possible we use aggregated or anonymous information which does not identify individual visitors to the Site.

Why We Collect Information

We collect this information for the purposes described in the section titled “How we use information”. The lawful basis for which we process your information is:

  • your consent;
  • processing is necessary for the performance of a contract to which you are a party. If you fail to provide this information, we may be unable to perform the contract;
  • processing is necessary for compliance with our legal obligations.
  • processing is necessary for the purpose of the legitimate interest pursued by us or a third party, except where your rights as a data subject override our legitimate interest.

How We Use Information

We will use your personal information:

  • to enable your registration for an account or newsletter;
  • for order fulfillment;
  • to customise your content;
  • to respond to customer service requests and similar communications from you;

We will never disclose your personal information to a non-affiliated third party without first receiving your permission. As necessary to provide our services to you, we may communicate your personal information to our project partners such as Shopify, third-party logistics and freight companies. We may host your personal information on these systems:

  • Disaster Recovery Repositories

  • Billing System
  • Electronically Stored Information Platforms

Manic Panic  will never willfully disclose any personally identifiable information about our visitors to any non-affiliated third party without first receiving the user’s (or if a child, the parent’s or guardian’s) permission. We do not collect personally identifiable information from our visitors other than what is supplied to us on a voluntary basis. Visitors may provide personally identifiable information to Manic Panic via (1) inquiring about our services, (2) electronic or written responses to letters, mailings, and other means of communication, and (3) during the course of providing our services to you. In addition, personally identifiable information may be voluntarily provided by the user in connection with certain content submissions, community postings (i.e., chats or bulletin boards), comments and suggestions, or voting.

This Site may make available to its users chat rooms, forums, message boards, and/or news groups. Any information that you disclose in these areas becomes public information and you should exercise extreme caution when deciding to disclose such information. Manic Panic  may use such information for its internal purposes, including but not limited to, editorial feedback, auditing, research and analysis in order to maintain, protect and improve the Website and the other goods and services offered or provided, marketing and promotional purposes. Manic Panic  may also use this information to deliver to you information about Manic Panic  and for trend analysis, pattern detection, and site administration. In addition, Manic Panic  may collect Internet Protocol (“IP”) addresses for the purposes of system administration and to report aggregate information to our advertisers. An IP address is a number that is automatically assigned to your computer whenever you are surfing the Web. If you are using the Shopify platform, Shopify uses the IP addresses for geo-location for active users, and Manic Panic is able to see the identity and demographics of the customer.

How We May Share Your Information

Manic Panic does not currently sell or license personal information. Before selling or licensing your personal information, we will post a notice in this Privacy Policy and on our home page and ask for your consent.

At this time, we do not share any personal information with our affiliates. It is possible that this policy will change in the future. If we do decide to share information with our other affiliates, we will post a notice in this Privacy Policy and on our home page.

  • We may share your personal information with companies that perform services for us, such as fulfilling orders, delivering packages, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, processing credit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service. They have access to personal information needed to perform their functions, but may not disclose your personally identifiable information for other purposes.
  • We currently share aggregate information about our customers with advertisers and marketing partners. This information does not identify individual users.
  • In the event there is a change in the corporate structure of Manic Panic including, without limitation, by merger, consolidation, sale, liquidation, or transfer of substantial assets, we may, in our sole discretion, transfer, sell or assign users’ information collected on and through the Sites to one or more affiliated or unaffiliated third parties or successor in interest.
  • We may disclose a user’s information when required to do so to comply with applicable law or legal process or to respond to a request from law enforcement authorities. We may also provide your information where necessary for the defense of legal claims or for fraud prevention purposes.

Some personal information is stored on servers owned by other companies. Except as otherwise described below, only we have the right to access this information.

Any content submitted when using our interactive services or through Third Party Sites will be displayed on our Sites, so please consider this before submitting any such content. Please don't submit any information that you don't want the whole world to know!

Opt-Out

Users may opt-out of receiving future marketing communications from Manic Panic  and other entities by clicking the unsubscribe button at the bottom of every email or emailing us at eugdpr@manicpanic.com.

Children Under 13

We comply with the Children's Online Privacy Protection Act of 1998. If you are under 18 years old, you may use the Site only under the supervision of a parent or guardian.  We do not wish to collect personal information from children under 13.  Should we become aware that a user under the age of 13 has registered without verifiable parental consent, any such information will be deleted.

If you are based in the European Union, the above provisions relating to children’s privacy generally apply to children under the age of 16, but this may vary across different member states.

International Transfers (EU based users)

If you are based in the EU, we may need to transfer your personal information to the USA for the purposes listed in this policy. Rest assured that we will always ensure any transfer is subject to appropriate security measures to safeguard your personal information.

For How Long We Keep Your Personal Information

We keep your information for no longer than is necessary. We will retain your information for any period required by law, and where we are not under a legal obligation to retain your information, we will determine what is necessary by reference to the lawful basis for processing set out above and our legitimate interests.

Your Rights Under Data Protection Law (If You Are Based in the EU)

You have a right to ask us to confirm whether we are processing information about you, and to request access to this information (‘right of access’). You also have the right to be informed of the safeguards we have in place relating to any transfers of your information to another country.

You may wish to exercise this right for any reason, for example where it is no longer necessary for us to continue holding or processing your personal data you may withdraw your consent. You should note that we are entitled to and reserve the right to retain your data for statistical purposes.   • the processing is unlawful and you ask us to restrict use of it instead of erasing it
  • we no longer need the information for the purpose of processing, but you need it to establish or defend legal claims
  • you have objected to processing of your information being necessary for the performance of a task carried out in the public interest, or for the purposes of our legitimate interests. The restriction would apply while we carry out a balancing act between your rights and our legitimate interests.
  • you exercise your right to restrict processing, we would still need to process your information for the purpose of exercising or defending legal claims, protecting the rights of another person or for public interest reasons.
  • You have a right to prevent us from processing your data for the purposes of marketing.

You have a right to report any of your concerns about our use of your data to the relevant data protection authority in your EU country.  

Technical Information

Manic Panic wants to give you the best possible experience when you visit the Site and our other Sites. We like to constantly update and improve the features on our Sites, we like to personalize your browsing and shopping experience and we like to recognize you when you return to Manicpanic.com. We have a variety of ways of doing this.

Cookies are pieces of information that a web site transfers to an individual’s hard drive for record-keeping purposes. Cookies make web-surfing easier for you by saving your subscription information and personal preferences while you are at our Site. The use of cookies is an industry standard, and you will find cookies at most major web sites. Cookies also help Manic Panic  to see which areas are popular and which are not popular and allow Manic Panic  to make improvements and updates to the Site based on such data as total number of visitors and pages viewed. This information is most easily tracked with cookies.

Log Files – Manic Panic  may use log files to track how our sites are being accesses and used. Log files track anonymous user information such as IP addresses, browser types, Internet service providers, referring and exit pages, platform type, date and time stamps, and number of clicks to, from, and within our sites.

Information from Banner Ads – If you arrive at the Site through a banner ad or other Affiliate referral device, Manic Panic may track from where you arrived as well as clicks that might have impacted our servers.

Manic Panic may use clear GIF Tracking Pixels to track user movement through our web sites for aggregated site traffic measuring. In addition, some Affiliates may set such tracking pixels on our web site pages to track completed forms and requests referred by their web sites.

Manic Panic , either directly or via its agents, may employ persistent cookie, web beacon or other technology (collectively “Analytics Technology”) that tracks unique users on the Site. The data collected by the Analytics Technology includes, but is not limited to, User ID, IP Address, User Agent, Date/Timestamp, Referral URL, Request URL, Review Submission ID, Client Name or ID, Product Category ID, Product ID, Website Category, Session ID, Click Events, Conversions, Site Visits, Average Time on Site, and other data passively generated by a user’s interaction with the Site.

Manic Panic also works with advertising partners (like Google and DoubleClick) that use cookies, pixel tags and other tracking technologies to serve advertisements on behalf of their retail clients, including us, across the Internet, including to you after you have visited our Sites. These advertising partners engage in remarketing, online behavioral advertising and ad delivery and reporting. With respect to our company, these advertising partners may collect anonymous information about your browser as it makes visits to websites across the Internet (including our Sites) and your interaction with our advertising and e-mail communications. This anonymous information may also be used to tailor advertising for you and others elsewhere on the Internet. Manic Panic will have access to the information collected by these advertising partners and can then use it in combination with personally identifiable information provided by you to us to enhance your experience on our Sites. We will not share that personally identifiable information with these advertising partners. Most browsers are initially set to accept cookies. If you prefer, you can change your browser settings to refuse cookies. However, in so doing, you may not be able to fully utilize the Manic Panic  Site or may experience difficulties accessing parts of the site.

Social Media and Other Third Parties

Manic Panic works with trusted third parties, including social network sites like Facebook, and with application developers who specialize in social media so Manic Panic can connect to your social networks. Other social networks Manic Panic may use include X, Instagram, TikTok, Pinterest, Tumblr, Youtube, and Reddit. All of these companies operate Third Party Sites. Manic Panic provide access to our Sites by third parties and business partners so we can generate interest in our products among members of your social networks and to allow you to share product interests with friends in your network.

The use of any features made available to you on our Sites by a third party may result in information being collected or shared about you by us or by the third party. Information collected or shared through any such third party features is considered "public information" by us because the Third Party Sites made it publicly available. If you do not want us to be able to access information about you from Third Party Sites, you must instruct Third Party Sites not to share the information. Manic Panic is not responsible for how these third parties may use information collected from or about you. However, we do identify any areas on our Sites where third parties share information about you. Manic Panic cannot control how your data is collected, stored, used or shared by Third Party Sites or to whom it is disclosed. Please be sure to review the privacy policies and privacy settings on your social networking sites to make sure you understand the information they are sharing.

Facebook's "Like" feature is a good example. (Other third parties have or may have similar ways for you to express positive opinions about our products - now or in the future.) Manic Panic has agreed to allow Facebook's "Like" feature to run alongside images of our products so you can "like" one of our products and to see how many other Facebook users "like" each of our products. You should know that Facebook may collect or register the fact that you "like" a product and may post that information to your "News Feed" on Facebook and to your Facebook profile's "Wall" and "Info" pages. So, the fact that you "like" one or more of our products may be made known to members of your Facebook network. This would be true for your friends too. If they "like" one of our products, you will see it on his or her News Feed, Wall or Info pages. Finally, by "liking" one of our products, you consent to the display of that information by us. If you do not wish this to happen, you should not click that you "like" a product and you should review your privacy settings on Facebook (or similar Third Party Site). Note that we are not obligated to display someone's name, profile photo or other "public" Facebook profile information on our website even if that Facebook user "likes" one of our products. Manic Panic reserves the right to remove the information of any person which we deem to be inconsistent with our ideals or otherwise inappropriate for public association with our company. Manic Panic may remove from our Sites, in our sole discretion, any product offering or any photo or product description relating thereto.

Manic Panic may decide to operate a Friends Store through Facebook (or comparable store on another Third Party Site) in the future. If we operate a Friends Store, and you "connect" with Facebook (using Facebook Connect or other connecting application) to the Friends Store on the Sites, you will be able to browse to discover which products are "liked" by your Facebook friends and by the larger Facebook community. If you are a Facebook user and you say that you "like" a product on our Sites or that you "like" us, we may then request that Facebook make your name, Facebook photo and other public profile information under the terms of Facebook's privacy policy available to the Friends Store. This information may then be displayed alongside the product in the Friends Store on our Sites to indicate that you "like" the product. The actual information that may be displayed in the Friends Store will vary depending on what information is made publicly available on Facebook.com. Manic Panic will collect and keep your Facebook profile identification only as long as is needed to operate the Friends Store.

Do Not Track Signals

Our Sites do not recognize Do Not Track signals. Some third parties may collect aggregate information about the users’ online activities over time and across websites when they use the Sites. While this information does not include personally identifiable information, certain processing activities that combine aggregate information with other information in possession of such third parties could result in the identification of users.

Security
Our site has industry standard security measures in place to protect the loss, misuse and alteration of the information under our control. Although there is no “perfect security” on the Internet, Manic Panic  will take all reasonable steps to ensure the safety of your personal information.

Hyperlinked Sites
No hyperlinking is permitted to the Site without the express written permission of Manic Panic .

Wireless Communications
If the email address you provide to Manic Panic  is a wireless address, you agree to receive messages at such address from Manic Panic . You understand that your wireless carrier’s standard rates apply to these messages. You represent and warrant that you are the owner or authorized user of the wireless device on which messages will be received, and that you are authorized to approve the applicable charges associated therewith.

Intellectual Property
Your use of the Site does not give you permission to use any of Manic Panic ’ names, logos, designs, slogans, product trademark or service marks (“Manic Panic ’s Marks”) in any manner, or to use Manic Panic ’s Marks or any other words or codes in any “metatag” or to use other information location tools to identify and select sites, without Manic Panic ’ express written permission for a particular use.

Use of the Site
You acknowledge that the personal information you provide to Manic Panic may be collected and stored in Europe or the United States. If the latter, you therefore consent to the transfer of information to and storage of the information in the United States, regardless of your country of domicile.

Severability
If any provision of this Privacy Policy is found to be illegal, void, or unenforceable, that provision will be deemed severed from the balance of the agreement and will not affect the validity and enforceability of the remaining provisions, which will continue in full force and effect.

 

Acknowledgement
By completing forms provided by Manic Panic  and providing personal information through the Site, through any means of communication with Manic Panic  or by using the Site and services contained therein, you hereby represent and warrant that:

  • You have read, understand and agree to Manic Panic’s Privacy Policy;
  • You are an actual person of at least 18 years of age, you have the right to provide the information that you submit to Manic Panic , and the information you submit is accurate, complete and truthful; and
  • If you do not agree to the terms of this Privacy Policy, then do not provide your information to Manic Panic through any means. In such case, Manic Panic  is relieved of any of its obligations to you as set forth in this Privacy Policy.

Manic Panic  may, at its sole discretion, revise this Privacy Policy at any time in a manner consistent with applicable laws and regulations. When we revise this policy, including changes to Manic Panic’s use of your personal information, we will incorporate the revisions into this policy and will revise the “last revised” date at the top of this web page. Manic Panic recommend that you review those changes in order to remain informed about how Manic Panic  uses your personal information.
